Welcome to Server Galactic Limited ("we," "us," or "our"). These Terms of Service ("ToS") govern your use of our web hosting, WordPress hosting, virtual private server (VPS), dedicated server, and domain registration services (collectively, the "Services"). By accessing or using our Services, you ("you," "Customer," or "User") agree to be bound by these ToS. If you do not agree, please do not use our Services.

1. Acceptance of Terms

By registering an account, placing an order, or using our Services, you confirm that you are at least 18 years old (or the age of majority in your jurisdiction) and have the legal capacity to enter into this agreement. If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these ToS.

2. Services Provided

Server Galactic Limited provides:

Web Hosting: Shared hosting plans for websites.

WordPress Hosting: Optimized hosting for WordPress sites.

VPS Hosting: Virtual private servers with customizable resources.

Dedicated Servers: Physical servers dedicated to a single customer.

Domain Registration: Registration and management of domain names through accredited registrars.

We reserve the right to modify, suspend, or discontinue any Service at our discretion, with reasonable notice to you where feasible.

3. Account Registration and Responsibilities

3.1 Account Creation

To use our Services, you must create an account and provide accurate, complete, and up-to-date information, including your name, email address, billing details, and, if required, identity verification documents.

3.2 Account Security

You are responsible for:

Maintaining the confidentiality of your account credentials.

All activities conducted through your account.

Notifying us immediately of any unauthorized access or security breaches.

3.3 Accurate Information

You agree to update your account information promptly if it changes. Providing false or misleading information may result in account suspension or termination.

4. Payment and Billing

4.1 Fees

You agree to pay all fees associated with the Services as specified during the order process. Fees are non-refundable except as outlined in our Refund Policy (see Section 12).

4.2 Billing

Services are billed in advance on a monthly, quarterly, or annual basis, depending on your plan.

Payments are due on the invoice date. Late payments may incur a late fee of 5% of the outstanding balance or the maximum permitted by Hong Kong law.

We accept payments via credit/debit cards, bank transfers, and other methods listed on our website.

4.3 Price Changes

We may adjust pricing for Services with at least 30 days’ notice. Price changes will apply at the start of your next billing cycle.

4.4 Taxes

All fees are exclusive of applicable taxes (e.g., GST or VAT). You are responsible for paying any taxes levied on the Services, except for taxes based on our income.

5. Bandwidth Fair Use for Unlimited Plans

Some of our hosting plans (e.g., shared or WordPress hosting) may offer "unlimited" bandwidth or storage. These are subject to a Fair Use Policy to ensure equitable resource allocation and service reliability.

5.1 Fair Use Policy

Unlimited Bandwidth: You may use bandwidth necessary for legitimate website operations (e.g., serving web pages, emails, or file downloads). Excessive or abusive usage, such as hosting large-scale file-sharing services, streaming platforms, or engaging in activities that disproportionately impact server performance, is prohibited.

Unlimited Storage: Storage is intended for website-related files (e.g., HTML, images, scripts). Using storage for backups, file archives, or non-website-related content is not permitted.

Monitoring: We monitor resource usage to identify accounts exceeding reasonable limits. Typical thresholds are based on the average usage of similar accounts (e.g., top 5% of users may be reviewed).

5.2 Actions for Excessive Use

If your usage violates the Fair Use Policy:

We will notify you and request corrective action (e.g., reducing bandwidth consumption).

You may be required to upgrade to a higher-tier plan or migrate to a VPS/dedicated server.

Failure to comply may result in throttling, suspension, or termination of your account.

6. Forbidden Use

You agree not to use our Services for any illegal, abusive, or harmful activities. Prohibited activities include, but are not limited to:

6.1 Illegal Activities

Engaging in or promoting activities that violate Hong Kong law or the laws of any jurisdiction where our Services are accessed.

Hosting or distributing content related to fraud, piracy, or intellectual property infringement.

6.2 Malicious Activities

Distributing malware, viruses, or other harmful code.

Conducting phishing, spamming, or hacking attempts.

Launching Distributed Denial of Service (DDoS) attacks or other network disruptions.

6.3 Prohibited Content

Hosting or linking to content that:

Is defamatory, obscene, or pornographic.

Promotes violence, hatred, or discrimination based on race, religion, gender, or other protected characteristics.

Violates third-party rights (e.g., copyrights, trademarks).

6.4 Resource Abuse

Overloading servers through excessive CPU, memory, or disk usage.

Running unauthorized scripts, bots, or cryptocurrency mining software.

Using shared hosting for purposes better suited to VPS or dedicated servers (e.g., high-traffic applications).

6.5 Unsolicited Communications

Sending unsolicited emails (spam) or engaging in bulk messaging without recipient consent.

6.6 Consequences of Violation

Violations of this section may result in immediate suspension or termination of your account, without refund. We may report illegal activities to law enforcement authorities and cooperate with investigations.

7. Domain Registration

7.1 Registrar Services

We facilitate domain registration through accredited registrars. By registering a domain through us, you agree to:

Comply with the registrar’s terms and conditions (e.g., ICANN policies).

Provide accurate WHOIS information.

Pay renewal fees on time to avoid domain expiration.

7.2 Domain Disputes

You are responsible for resolving any domain disputes (e.g., trademark claims). We are not liable for losses arising from domain suspension, transfer, or cancellation.

7.3 Domain Renewals

We will send renewal reminders, but you are responsible for ensuring timely renewals. Failure to renew may result in domain loss.

8. Intellectual Property

8.1 Your Content

You retain ownership of all content you upload to our Services. By using our Services, you grant us a non-exclusive, worldwide, royalty-free license to host, store, and back up your content as necessary to provide the Services.

8.2 Our Intellectual Property

All Server Galactic Limited branding, software, and website content are our property or licensed to us. You may not reproduce, modify, or distribute our intellectual property without written permission.

8.3 DMCA and Takedown Requests

If we receive a valid copyright infringement notice, we may remove or disable access to the allegedly infringing content and notify you. Repeated violations may lead to account termination.

9. Liability

9.1 Limitation of Liability

To the maximum extent permitted by Hong Kong law:

Our total liability for any claim arising from the Services (including negligence) is limited to the amount you paid for the Services in the 12 months preceding the claim.

We are not liable for indirect, incidental, or consequential damages, including loss of profits, data, or business opportunities.

9.2 No Liability for Third Parties

We are not responsible for:

Actions or content of third parties (e.g., users, domain registrars, or service providers).

Losses caused by your failure to secure your account or content.

9.3 Service Interruptions

While we strive for 99.9% uptime, we are not liable for interruptions due to:

Scheduled maintenance (with reasonable notice).

Force majeure events (e.g., natural disasters, cyberattacks, or government actions).

Your misuse of the Services.

9.4 Data Loss

You are responsible for maintaining backups of your data. We are not liable for data loss due to hardware failure, user error, or other causes, though we implement reasonable backup measures.

10. Indemnification

You agree to indemnify and hold Server Galactic Limited, its affiliates, officers, and employees harmless from any claims, losses, or damages (including legal fees) arising from:

Your use of the Services.

Your violation of these ToS or applicable laws.

Your content infringing third-party rights.

11. Termination

11.1 By You

You may terminate your account at any time by:

Submitting a cancellation request through your account portal.

Paying any outstanding fees.

Termination does not entitle you to a refund unless covered by our Refund Policy.

11.2 By Us

We may suspend or terminate your account, with or without notice, if you:

Violate these ToS (e.g., engage in forbidden use).

Fail to pay fees within 7 days of the due date.

Engage in activities that harm our infrastructure or reputation.

File for bankruptcy or become insolvent.

11.3 Effects of Termination

Upon termination:

Your access to the Services will cease.

We may delete your data after 30 days, subject to legal obligations.

You remain liable for any fees incurred before termination.

11.4 Notice

Where feasible, we will provide 7 days’ notice of termination, except in cases of severe violations (e.g., illegal activities), where termination may be immediate.

12. Refund Policy

Money-Back Guarantee: Shared and WordPress hosting plans include a 30-day money-back guarantee. Refunds are issued if you cancel within 30 days of initial signup, excluding setup fees, domain registration fees, or add-ons.

VPS and Dedicated Servers: No refunds are offered unless specified at purchase.

Domain Registrations: Domain fees are non-refundable once registered.

Prorated Refunds: No prorated refunds are provided for unused portions of billing cycles unless required by law.

13. Modifications to Terms

We may update these ToS to reflect changes in our Services or legal requirements. We will notify you of material changes via email or a website notice at least 30 days in advance. Continued use of the Services after changes take effect constitutes acceptance of the updated ToS.

14. Force Majeure

We are not liable for delays or failures to perform due to events beyond our reasonable control, including natural disasters, war, terrorism, or internet outages.

15. Governing Law and Dispute Resolution

15.1 Governing Law

These ToS are governed by the laws of Hong Kong, without regard to conflict of law principles.

15.2 Dispute Resolution

Any disputes arising from these ToS will be resolved through good-faith negotiations.

If unresolved, disputes will be submitted to the exclusive jurisdiction of the courts of Hong Kong.

You waive any right to participate in class action lawsuits against us.

16. Miscellaneous

16.1 Entire Agreement

These ToS, along with our Privacy Policy and any service-specific agreements, constitute the entire agreement between you and Server Galactic Limited.

16.2 Severability

If any provision of these ToS is found unenforceable, the remaining provisions will remain in effect.

16.3 Waiver

Our failure to enforce any provision does not waive our right to enforce it later.

16.4 Assignment

You may not assign your rights or obligations under these ToS without our written consent. We may assign our rights to an affiliate or successor.
